Rankin Ellison was first established in 1899. We are now a full service legal practice, offering lawyers who have proven expertise in their fields.

Ten of our Senior Lawyers have at least 10 years' litigation experience. Six of them have held positions as senior litigation partners in litigation firms. Seven of our senior lawyers have experience in catastrophic claims litigation. Each lawyer is selected with an emphasis on the provision of quality work, performed efficiently and effectively.

Our offices are in Sydney and Newcastle. We provide personal solutions, with the experience, specialised knowledge and expertise our clients expect to receive. What test should apply for proving medical treatment is ‘reasonably necessary’?

The Applicant, Ms Fallone, sustained two separate workplace injuries in the course of her employment with the Respondent, for which she received compensation, and also sustained injuries as a result of an unrelated motor vehicle accident. She underwent unapproved right shoulder surgery, and later brought proceedings in the Commission for the costs associated with the surgery as well as payment for a period of incapacity which resulted thereafter. The Arbitrator entered an award in favour of the Respondent, finding that the surgery and her subsequent incapacity was not sufficiently connected to her workplace injuries.
